Photography & Retouching Services

Before using my photography and/or retouching services, please read these terms and conditions carefully. In case of any doubt, please contact me for clarification.

1) Definitions

1.1 Photographer / Retoucher refers to Lizzy Rose.
1.2 Client refers to the person or organisation to whom the invoice is addressed (whether or not acting on behalf of a third party).
1.3 Photographs means all photographic material supplied, including prints, digital files, scans, artwork, montage, or any other items.

2) Copyright

2.1 The entire copyright of all Photographs and Retouched images remains with the Photographer/Retoucher at all times worldwide.

3) License to Use

3.1 The License to Use grants specific rights to the Client as outlined in the quote/contract.
3.2 Any authorisation is revoked if full payment is not received by the due date, or if the Client undergoes liquidation/receivership.
3.3 Permission for usage beyond the agreed license requires an additional fee, to be agreed in advance.
3.4 The Client must ensure any third-party rights (e.g., stylists, models, stock imagery, photographers) are secured before use.

4) Client Responsibilities

4.1 The Client is responsible for providing accurate briefs, including editing requirements, technical specifications, usage licenses, image sizes, formats, and copy/text changes.
4.2 For external photographs submitted for retouching, the Client must confirm they hold the necessary usage rights and inform the Retoucher of any license or credit requirements.
4.3 The Client is responsible for obtaining any property/model release forms unless otherwise agreed.

5) Scope of Work (Retouching)

5.1 The Retoucher will deliver professional editing as per the agreed brief.
5.2 Unless requested otherwise, images will be supplied as flattened PSD and JPEG files. Layered files must be requested prior to project commencement.
5.3 Skin retouching will be limited to removing blemishes/temporary imperfections and will not alter facial structure or body proportions.
5.4 Additional retouching time may be required for packaging/product condition issues, which will be discussed and invoiced separately.

6) Confidentiality

6.1 All Client information and imagery will remain confidential and will not be shared with third parties without permission.

7) Use of AI in Retouching

7.1 The Retoucher may use AI-assisted tools (e.g., for background removal, skin adjustments) to enhance workflow.
7.2 Clients may request AI not be used, but this must be agreed before work begins.
7.3 All AI edits will be reviewed and refined to maintain professional standards.

8) Exclusivity

8.1 The Client may publish licensed images exclusively.
8.2 The Photographer/Retoucher retains the right to use the work for self-promotion (portfolio, website, social media) unless the Client specifies otherwise before the project is published.

9) Amendments

9.1 One round of amendments is included within 10 days of delivery (capped at 1 hour per 8 hours editing, or 30 minutes per 4 hours).
9.2 Additional amendments will be charged at standard retouching rates.

10) Bookings & Cancellations

10.1 A booking is confirmed upon receipt of a PO number or 50% deposit.
10.2 Cancellations are subject to the following fees:

  • 72 hours before shoot: 15%

  • 48 hours before shoot: 25%

  • 24 hours before shoot: 50%

  • On the day: 100%
    10.3 Any expenses already incurred (e.g., props, travel) must also be covered.

11) Payments

11.1 Payment terms are 60 days from invoice unless agreed otherwise.
11.2 Late payments are subject to statutory interest under the Late Payment of Commercial Debt (Interest) Act 1998.
11.3 Additional invoices may be issued for overdue accounts.

12) Quotations

12.1 Quotes are based on the agreed brief and may be revised if requirements change.
12.2 Additional images, retouching, or revisions outside the original scope will be invoiced separately.

13) Indemnity

13.1 The Photographer/Retoucher takes all reasonable care but shall not be liable for loss/damage suffered by the Client or third parties.
13.2 Responsibility for third-party clearances (copyrights, trademarks, designs) lies with the Client unless otherwise agreed.

14) Liability

14.1 The Photographer/Retoucher is not liable for indirect or consequential losses, including profit, contracts, or business revenue.

15) Number of Images & Shoot Duration (Photography)

15.1 A reasonable number of images can be captured within one shoot day.
15.2 If the brief cannot be fulfilled within the booked time, an additional shoot must be arranged.

16) Travel & Additional Expenses

16.1 Travel expenses (taxis, mileage, parking, congestion charge) will be invoiced as per the quote.
16.2 Props, ingredients, and backgrounds will be itemised, approved in advance, and invoiced separately.

17) Sickness & Unforeseen Circumstances

17.1 If illness or unforeseen circumstances prevent completion, the Photographer/Retoucher will reschedule or refund proportionally based on work completed.
17.2 Clients will be notified promptly of any delays with revised timelines offered.

18) Styling (Photography)

18.1 If no stylist is booked, the Client may be expected to assist with styling on the shoot day.
18.2 For online/virtual shoots, work will proceed based on the Client’s brief.

19) Professional Conduct

19.1 All communication must be professional and respectful.
19.2 Rude, abusive, or disrespectful conduct will result in immediate termination of the project and revocation of licenses.
19.3 Payment remains due for work completed and expenses incurred.

20) Storage of Imagery

20.1 Finished projects will be archived for up to three months after completion.
20.2 The Client is responsible for securing final deliverables within this period.

21) Applicable Law

21.1 This agreement is governed by the laws of England & Wales and subject to the exclusive jurisdiction of the English courts.

22) Variation

22.1 These Terms & Conditions shall not be varied except by agreement in writing.
